The Bid Lab AI Use Policy
1. Introduction
This Artificial Intelligence (AI) Use Policy (“Policy”) governs Bid Lab LLC’s use of artificial intelligence technologies, machine learning algorithms, and automated systems (collectively, “AI Systems”) in connection with consulting services provided by Bid Lab LLC to its clients. This Policy is incorporated by reference into all Bid Lab LLC client engagement agreements.
Scope. This Policy applies solely to Bid Lab LLC’s human-staffed consulting engagements. It does not apply to, and is not incorporated into, the Bid Banana Self-Service Tool operated by Bid Lab Technologies, LLC, which is governed instead by the separate Bid Banana Self-Service AI Use Policy. Bid Lab LLC and Bid Lab Technologies, LLC are separate, affiliated entities under common ownership; references to “Bid Lab” in this Policy mean Bid Lab LLC only, unless otherwise stated.
2. AI Usage Scope
Bid Lab may, in its sole professional discretion, utilize AI Systems to assist in providing services to clients. Such usage is intended to enhance the efficiency and comprehensiveness of our service delivery. AI implementation may include, but is not limited to, data analysis, data organization, research assistance, document drafting and administrative functions. Bid Lab maintains exclusive authority to determine when and how to implement AI Systems in our service delivery.
Bid Lab integrates AI Systems throughout its service delivery to enhance speed, comprehensiveness, and consistency. AI assistance may be applied to research, document analysis, drafting, compliance review, formatting, and quality checks. The specific tools and stages of AI usage may evolve as the technology and our methodology develop. AI usage is a standard part of our service rather than an optional add-on.
3. No Guarantees or Warranties
Notwithstanding our review process, AI Systems are inherently experimental and evolving technologies. Bid Lab makes no representations or warranties regarding the accuracy, reliability, appropriateness, or completeness of any output generated by AI Systems. All AI-generated content is provided “as is” without warranty of any kind.
4. Human Oversight
A qualified Bid Lab professional reviews the work product at each key stage of the engagement before it is delivered to Client or submitted on Client’s behalf. AI-generated content is treated as a draft for human review, not as final work product. The reviewing professional retains authority to revise, reject, or regenerate any AI output.
This human-review process applies to The Bid Lab’s professional consulting engagements only. It does not apply to Bid Banana’s Self-Service Tool, which generates AI Output through fully automated means without review by any human professional. Users of the Self-Service Tool receive no human oversight of their AI Output and are solely responsible for reviewing and verifying it before use.
5. Client Responsibility
CLIENT BEARS SOLE RESPONSIBILITY FOR REVIEWING ALL WORK PRODUCT, INCLUDING ANY AI-GENERATED CONTENT, PROVIDED BY BID LAB. CLIENT ACCEPTS FULL RESPONSIBILITY FOR ALL CONSEQUENCES RESULTING FROM THE USE OF OR RELIANCE UPON SUCH WORK PRODUCT.
6. Data Usage and Confidentiality Risks
Bid Lab implements reasonable security measures when processing client information through AI Systems. However, Client acknowledges that the use of third-party AI technologies may present inherent confidentiality risks that cannot be fully mitigated. Such risks may include, but are not limited to, potential data exposure to AI system providers, limitations in AI systems’ ability to recognize sensitive information, and the evolving nature of AI security protocols.
BY AGREEING TO THIS POLICY, CLIENT EXPRESSLY ASSUMES ALL RISKS ASSOCIATED WITH THE PROCESSING OF CLIENT INFORMATION THROUGH AI SYSTEMS AND RELEASES BID LAB FROM ANY LIABILITY RELATED TO SUCH CONFIDENTIALITY RISKS.
By engaging Bid Lab’s services, clients acknowledge that anonymized usage data may be utilized to improve our AI Systems. All confidentiality obligations in the engagement agreement apply to our AI usage, subject to the limitations described in this section.
7. Limitation of Liability
In addition to any limitations of liability in the engagement agreement, Bid Lab shall not be liable for any damages arising from:
- Errors, inaccuracies, or omissions in AI-generated content
- Decisions made by client based on AI-generated content
- Any unintended consequences of AI System usage
- Any third-party claims of intellectual property infringement related to AI-generated content
- Any confidentiality issues or data security incidents related to AI Systems
8. Intellectual Property
Bid Lab retains all rights, title, and interest in the AI Systems used to provide services. Client receives a limited license to use the output generated by such AI Systems solely for the purposes contemplated under the engagement agreement.
9. Compliance With Laws
Bid Lab endeavors to use AI Systems in compliance with applicable laws and regulations. Client acknowledges that laws governing AI usage are evolving, and both parties agree to cooperate in addressing any new legal requirements.
10. Policy Updates
Bid Lab reserves the right to modify this Policy at any time. Updated versions will be posted on our website and will be effective immediately upon posting. Client’s continued engagement of our services after such modifications constitutes acceptance of the updated Policy.
